Terms of Use
Effective Date: 14 August 2026
These Terms of Use govern access to and use of the website operated by “Armenian Treasures” Historical and Cultural Foundation. Please read these Terms of Use carefully before using the Website or making a donation. 1. Acceptance of the Terms
These Terms of Use govern access to and use of the website operated by “Armenian Treasures” Historical and Cultural Foundation (the “Foundation”) and the services made available through it. For the purposes of these Terms of Use, “Website” means the Armenian Treasures online platform operated by the Foundation, and “User” means any individual who accesses or uses the Website. By accessing or using the Website, the User confirms that they have read, understood and agreed to be bound by these Terms of Use. If the User does not agree with any provision of these Terms, the User must discontinue use of the Website. The processing of the User’s personal data is governed by the Foundation’s Privacy Policy and Cookie Policy, which should be read together with these Terms of Use. 2. About the Website
The Website presents Armenian historical and cultural heritage, educational materials, digital experiences, the Foundation’s activities and opportunities to support its mission. The Website’s content is provided for general cultural, educational and informational purposes. Unless expressly stated otherwise on the Website, its content does not constitute professional, legal, historical, archaeological, conservation or other specialised advice. 3. Eligibility
The User may access the Website’s publicly available cultural and educational content regardless of age, subject to applicable law. To make a donation, the User must be at least 18 years old and have the legal capacity required to complete the relevant transaction. By making a donation, the User confirms that they satisfy these requirements and are authorised to use the selected payment method. A minor’s permitted use of the Website must take place with the knowledge and supervision of a parent or legal guardian. The parent or legal guardian is responsible for ensuring that the minor’s use of the Website complies with applicable law and these Terms of Use. 4. Donations
Donations made through the Website are voluntary and gratuitous contributions intended to support the Foundation’s statutory historical, cultural, educational and heritage-preservation objectives. Unless the Foundation has expressly accepted a restricted donation in writing, the Foundation may allocate donated funds at its reasonable discretion in furtherance of its mission and statutory objectives. A donation does not provide the User with any ownership interest in the Foundation or its property, governance or voting rights, investment returns, financial profit or entitlement to a specific service. Any certificate, title, status, acknowledgement or other form of recognition provided to a donor is symbolic, has no monetary value and does not confer ownership, governance or any other legal rights unless expressly stated otherwise by the Foundation in writing. When making a donation, the User must provide accurate and complete information and confirms that they are authorised to use the selected payment method. Available payment methods, currencies, conversion terms and third-party charges may vary depending on the User’s location, card issuer and the relevant payment service provider. Applicable charges must be displayed before the User finally confirms the transaction where their display is within the control of the Foundation or the payment service provider. A payment service provider, financial institution or the Foundation may decline, delay, review, suspend or reverse a transaction where reasonably necessary for payment authentication, security, fraud prevention, sanctions compliance or compliance with legal or regulatory obligations. 5. Acknowledgements, Tax Treatment and Refunds
The Foundation may issue a donation confirmation, receipt or acknowledgement certificate using the information provided by the User. The tax treatment of a donation depends on the User’s jurisdiction and individual circumstances. The Foundation does not guarantee that a donation qualifies for any tax deduction, relief or reimbursement in any jurisdiction. The User is responsible for obtaining independent tax advice where necessary. Processed donations are generally final and non-refundable, except where: * a refund is required by applicable law; * a duplicate, erroneous or unauthorised transaction has been verified; * the payment cannot lawfully be accepted or retained; or * the Foundation approves a refund at its reasonable discretion after considering the circumstances of the transaction. A refund request must be submitted as soon as reasonably possible to [DONATION SUPPORT EMAIL] and must include information reasonably necessary to identify the transaction. A refund may be subject to the procedures, restrictions and processing times of the relevant payment service provider or financial institution. Nothing in this section limits any rights of the User that cannot be excluded or restricted under applicable law. 6. Permitted Use of the Website
Subject to compliance with these Terms of Use, the Foundation grants the User a limited, non-exclusive, non-transferable and revocable right to access the Website and view its publicly available content for personal, educational and non-commercial purposes. The User may share links to publicly available pages of the Website, provided that doing so does not create a false or misleading impression of sponsorship, partnership, endorsement or official association with the Foundation. Except where permitted by applicable law or expressly authorised in advance by the Foundation in writing, the User must not: * reproduce, copy, publicly display, distribute, modify, translate, adapt or commercially exploit a substantial part of the Website’s content; * download, extract, reproduce or reuse any 3D models, virtual tours, databases, videos, photographs or other digital materials available on the Website; * use automated means to collect data or conduct scraping, crawling or data mining, except where authorised by the Foundation in writing; * bypass access, digital-rights-management, payment or security measures; * interfere or attempt to interfere with the operation of the Website, its servers or connected systems; * introduce malicious code, viruses or other harmful technology; * impersonate any person or organisation or misrepresent an association with the Foundation; * infringe the intellectual-property, privacy or other rights of any third party; or * use the Website for any unlawful, fraudulent or harmful purpose or in breach of these Terms of Use. Nothing in this section restricts any use expressly permitted by applicable law that cannot lawfully be limited by contract. 7. Intellectual Property Rights
The Website and its legally protected content, including text, photographs, images, videos, audio recordings, graphic elements, 3D models, virtual tours, databases, software, Website structure and design, are owned by the Foundation or the relevant rights holders and are protected by applicable copyright, related-rights, database-rights, trade-mark and other intellectual-property laws. The Foundation’s name, logo and other identifying marks may not be used without the Foundation’s prior written permission in any manner that creates a false or misleading impression of sponsorship, partnership, endorsement or official association. The fact that an underlying historical or cultural work, object or source may be in the public domain does not, by itself, mean that a photograph, digitisation, 3D model, translation, description, commentary, database arrangement or audiovisual presentation of that material is free from separate legal protection. Such materials are protected to the extent permitted by applicable law. Use of the Website does not transfer to the User any ownership or intellectual-property rights in the Website or its content. Notices of alleged infringement may be sent to the contact address specified in Section 16 and must include sufficient information identifying the relevant material, the right allegedly infringed and the basis of the request. 8. Content Accuracy and Digital Reconstructions
The Foundation uses reasonable efforts to ensure the accuracy and appropriate sourcing of the cultural, historical and educational materials presented on the Website. However, historical information, dates, attributions, translations, provenance information and scholarly interpretations may be incomplete, disputed or revised as new research and sources become available. 3D models, virtual tours, illustrations and other digital reconstructions may include approximate, interpretative or hypothetical elements and should not be regarded as perfectly accurate reproductions of a historical object, structure or environment. Website content should not be used as the sole basis for professional examination, authentication, valuation, conservation, restoration, provenance determination, legal or other specialised decisions. 9. Third-Party Services and Links
The Website may contain payment functionality, embedded content, maps, videos, social-platform tools or other services provided by third parties, as well as links to third-party websites. Those services may be governed by the relevant third party’s terms and policies. The Foundation does not control or endorse all third-party content, practices or service availability and is not responsible for them, except where and to the extent that such responsibility cannot be excluded under applicable law. Before using a third-party service, the User should review the applicable service terms, privacy notice and charges. 10. Website Availability, Modification and Access Restrictions
The Foundation may reasonably modify, update, temporarily suspend or remove Website content or functionality for maintenance, security, legal, technical or operational reasons. The Foundation does not guarantee that the Website or any particular functionality will always be available. The Foundation may restrict or suspend a User’s access if it reasonably believes that the User has breached these Terms or applicable law, endangered the Website or other persons, or used the Website for fraudulent, harmful or unauthorised purposes. Where reasonably practicable and without compromising security, legal or investigative measures, the Foundation may inform the User of the reason for the restriction and provide an opportunity to remedy the breach. Modification or discontinuation of the Website or any functionality does not affect the Foundation’s obligations concerning donations already processed, mandatory accounting records or other obligations imposed by applicable law. 11. Warranties
The Foundation exercises reasonable care in operating the Website and administering donation functionality under its direct control. However, to the maximum extent permitted by applicable law, the Website and its content are provided on an “as available” basis, without any guarantee of uninterrupted or error-free operation or compatibility with every device or system. The Foundation does not guarantee that the Website will always be free from technical errors, harmful components, data loss or unauthorised third-party interference, but it applies reasonable organisational and technical measures intended to reduce those risks. Nothing in these Terms excludes any warranty, obligation or remedy that cannot lawfully be excluded or limited under applicable law. 12. Limitation of Liability
Nothing excludes or limits the Foundation’s liability for fraud, wilful misconduct, gross negligence where liability for it cannot lawfully be limited, death or personal injury caused by conduct for which the Foundation is legally responsible, or any other liability that cannot be excluded or limited under applicable law. Where required by applicable law, the Foundation is responsible for losses that are a direct and reasonably foreseeable result of the Foundation’s breach of these Terms or negligence. To the extent permitted by applicable law, the Foundation is not liable for indirect or consequential losses, or for loss of profit, revenue, business opportunity, reputation or data, where such loss is not a direct and reasonably foreseeable result of the Foundation’s breach. The Foundation is not responsible for delay or inability caused by events outside its reasonable control, failures of communications or financial systems, or acts of independent third parties, provided that the Foundation has taken the measures reasonably expected in the circumstances. This Section does not limit any right to request a refund under Section 5 or applicable law. 13. Governing Law and Dispute Resolution
These Terms, their subject matter and any non-contractual obligations arising from them or from use of the Website are governed by the laws of the Republic of Armenia. If a dispute arises, the User and the Foundation must first attempt to resolve it in good faith through negotiation. The User may submit a written complaint to the contact address specified in Section 16, describing the dispute and the requested resolution. The parties must use reasonable efforts to reach a resolution within 30 days after receipt of the complaint. If the dispute is not resolved through negotiation, it is subject to the exclusive jurisdiction of the competent courts located in Yerevan, Republic of Armenia, except where applicable mandatory law entitles the User to bring a claim or pursue another remedy before another competent authority or in another jurisdiction. The choice of law and jurisdiction does not deprive a User who is a consumer of any mandatory protection under the law of the User’s habitual residence that cannot be limited or excluded by contract. Nothing in this Section prevents either party from requesting urgent or interim relief from a competent court where necessary to protect a right or security interest. 14. Changes to These Terms
The Foundation may amend these Terms to reflect legal, security, technical, operational or Website-service changes. The revised version will be published on the Website with a new effective date. If a change materially affects Users’ rights or obligations, the Foundation will provide reasonable additional notice where required by applicable law or practicable in the circumstances. Changes apply from their stated effective date and do not operate retroactively in relation to a donation already processed, unless required by law or expressly agreed with the relevant User. Continued use of the Website after the effective date of a revision is governed by the revised Terms. If the User does not agree to the revised Terms, the User must discontinue use of the Website. 15. General Provisions
These Terms, any additional terms clearly presented at the time a donation is confirmed, and any separate written agreement between the parties constitute the entire agreement concerning use of the Website and the relevant donation. In the event of a conflict, a separate written agreement prevails only to the extent of that conflict. If any provision of these Terms is held by a competent authority to be unlawful, invalid or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue in full force and effect. A failure or delay by the Foundation in exercising any right does not constitute a waiver of that right. A waiver in relation to one breach does not constitute a waiver in relation to any later or different breach. Section headings are included only for convenience and do not affect the interpretation of these Terms. These Terms may be published in Armenian and English. If the versions are inconsistent, the Armenian version prevails to the extent permitted by applicable law and without limiting the User’s mandatory rights. 16. Contact
